k.. Upon request by the Goverrwnent. the Town will furnish evidence of

title reflecting a suffic1erlt property interest in the flood control works to

protect the Government. and will furnish a certificate from its attorney that

the property interests held by the Town are sufficient to protect the G'Jvernment

in entering upon and constructing such Project.

2. The Town hereby gives the Government a right to enter. at reason-

abl~ times and in a reasonable manner, upon lands which the Town owns or controls,

for access to the Project for the purpose of inspection. and for the purpose of

completing, repairing and maintaining the Project if such in~pection shows that

the Town. for any reason. is failing to repair and maintain the Project in

accordance with the assurances hereunder and has persisted in such failure

after a reasonable notice in writing by the Government delivered to the Mayor

or Town Clerk.. No repair and maintenance by the Government in such event shall

operate to relieve the Town of responsibility to meet its obligations as set

forth in paragraph 1 of this Agreement. or to preclude the Government from

pursuing any other remedy at law or equity.

3. The Town promrtses to comply with the Relocation Assistance Act,

and without limiting the generality of the foregoing, promises:

a. Payments and services required ~y Sections 210 and 305 of the

Act, as implemented by regulations prescribed by or under the authority of the

Secretary of the Ar~. will be provided.

b. Within a reasonable time prior to displacement. decent, safe and

sanitary dwellings will be made available to displaced persons in accordance

with standards established by regulations pres-:ribed by or under tile authority

of the Secretary of the Army.

c. In acquiring real property, the Town will be guided to the

greatest extent practicable by the land acquisition policies in Sections 301

and 302 of the Act; and property owners will be paid or reimbursed for necessary

expenses as specified in Sections 303 and 304 of the Act; all as implemented

by regulations prescribed by or under the authority of the Secretary of the Army.

d. The Town will furnish an annual report on its activities with

respect to the programs and policies established or authorized by the Act to

facilitate compliance with the reporting requirement contained in Section 214

thereof.
