<br />. <br /> <br />. <br /> <br />. <br /> <br />WHEREAS, the Town of Lyons has requested that the Colorado Water Conservation Board <br />rescind Resolution No. 201 and those portions of Resolution No, 294 that were not within the <br />corporate limits of the Town of Lyons in December 1987 but are within the corporate limits of the <br />Town of Lyons in June 1998; and <br /> <br />eR.s. Authoritv <br /> <br />WHEREAS, Section 37-60-106(l)(c), Colorado Revised Statutes, requires the Colorado Water <br />Conservation Board to assist in the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along any <br />storm or floodwater runoff channel or basin only after designation and approval by the Colorado Water <br />Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, directs the Colorado Water <br />Conservation Board to designate and approve storm or floodwater runoff channels or basins and to <br />make such designations available to legislative bodies oflocal jurisdictions; and <br /> <br />Compliance with CWCB Technical Standards <br /> <br />WHEREAS, the floodplain information in said report meets all of the requirements for detailed <br />floodplain information listed under the Board's "Rules and Regulations for the Designation and <br />Approval of Floodplains and of Storm or Floodwater Runoff Channels in Colorado" (2 CCR 408-1); <br /> <br />Desil!nation. Approval and Rescission Action <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Colorado Water Conservation Board in <br />regular meeting assembled in Telluride, Colorado, this 13th day of July, 1998, that it does hereby <br />designate and approve as detailed floodplain information the 100-year floodplains as described by the <br />floodplain delineations and floodwater surface elevations in said report dated June 1998; and <br /> <br />BE IT FURTHER RESOLVED that the Board does hereby rescind the 100-year floodplains as <br />described by the floodplain delineations and floodwater surface elevations in Resolution No. 201, those <br />portions of Resolution No, 294 which were outside the corporate limits of the Town of Lyons, as they <br />were in December 1987, those portions of Resolution No. 336 which were outside the corporate limits <br />of the Town of Lyons, as they were in July 1988, and those portions of Resolution No. 354.10 which <br />were outside the corporate limits of the Town of Lyons, as they were in August 1978, but which were <br />within the corporate limits ofthe Town of Lyons, as they were in June 1998; and <br /> <br />BE IT FURTHER RESOLVED that the Secretary of the Board is directed to send a certified <br />copy of this resolution to the Town of Lyons; the City of Longmont; the Board of County <br /> <br />3 <br />
