<br />FPR 228 <br /> <br />COLORADO WATER CONSERVATION BOARD <br />823 State Centennial Building <br />1313 Sherman Street <br />Denver, Colorado 80203 <br /> <br />January 5, 1984 <br /> <br />.R E SOL' UTI 0 N <br /> <br />WHEREAS, a floodplain information report entitled "Flood <br />Hazard Area Delineation, Westerly Creek," dated March, 1983, has <br />been prepared by Merrick and Company at the request of the Urban <br />Drainage and Flood Control District. the City and County of <br />Denver, and the City of Aurora; and <br /> <br />WHEREAS, said report describes and outlines the floodplain <br />data and information for the storm and floodwater runoff channels <br />or basins of the study area; and <br /> <br />\'1HEREAS, the Urban Drainage" and Flood Control District has <br />requested the Colorado Water Conservation Board to designate and <br />approve the floodplain areas asset forth in the aforesaid <br />_~' report; and <br /> <br />WHEREAS, <br />1973, requires <br />,the prevention <br /> <br />Section 37-60-106 (1), Colorado Revised Statutes <br />the' Colorado Water Conservation Board to assist in <br />of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised <br />Sta,tutes 1973, provide that such legislativ~ bodies of local <br />jurisdictions may provide zoning regulations fot land uses on or <br />along any storm or floodwater runoff channel. or basin only after <br />designation and approval by the Colorado Water Conservation <br />Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes <br />1973, directs the Colorado Water Conservation Board to designate <br />and approve storm or floodwater runoff channels or basins and to <br />make such designations available to legislative bodies of local <br />jurisdictions; and <br /> <br />WHEREAS, the staff of the Board has reviewed said report and <br />does hereby recommend to the Colorado Water Conservation Board <br />that the Board designate and approve as floodplain areas those <br />areas inundated by a 100-year flood (intermediate regional flood) <br />as described by the floodwater, surface elevations and profiles in <br />said report; <br /> <br />128 <br />FPR228 <br />
