<br />D. Pike, Roosevelt, San Isabel, and Arapaho National Forests <br />w-8977-77, W-9052-77, W-9064-77, W-9065-77. <br /> <br />REQUEST NO. 44. With respect to the United States claims for <br />"unquantified instream flows" for purpose of suppressing and controlling forest <br />fires on the Pike, Roosevelt, San Isabel, and Arapaho National Forests, admit <br />that the United States is not claiming a water right to maintain instream <br />flows, but rather a water right to divert an unquantified amount of water from <br />an unspecified source. <br /> <br />ANSWER. As stated in the United States' amended applications, the United <br />States admits that it claims reserved rights to the use of unquantified <br />amounts of water from the flows of rivers, streams, creeks and lakes for <br />controlling and suppressing forest fires on the Pike, Roosevelt, San <br />Isabel, and Arapaho National Forests. The United States denies that these <br />claims are for "unquantified instream flows" as stated in Request for <br />Admission No. 44. The United States admits that these claims are for an <br />unquantified aaount of water from sources whose locations are not <br />specifically identified. Without a more specific REQUEST FOR ADMISSION, <br />the United States is unable to admit or deny the remainder of REQUEST FOR <br />ADMISSION No. 44. <br /> <br />12 <br />
