WHEREAS, a floodplain information report entitled ''Flood
Plain Information, Kiowa Creek at Elbert, Colorado," dated January,
1977, has been prepared by United Western Engineers at the request of
Elbert County; and

WHEREAS, said report describes and outlines the floodplain
data and information for the storm and floodwater runoff channels or
basins of the study area; and

. WHEREAS, the Board of COU~ty Commissioners of Elbert County
has requested the Colorado Wate~ Co~servation Board to designate and
approve the floodplain areas as set forth in the aforesaid report; and

WHEREAS, Section 37-60-106(1), Colorado Revised Statutes
1973, requires the Colorado Water CQnservation Board to assist in the
prevention of floods and flood damaees therefrom; and

WHEREAS, Sections 31-23-201 and 30-28-111, Colorado Revised
Statutes 1973, provide that such 1e~is1ative bodies of local juris-
dictions may provide zoning regu1at~ons for land uses on or along any
storm or floodwater runoff channel ~r basin only after designation and
approval by the Colorado Water Cons~rvation Board; and

WHEREAS, Section 37-60-10~(1)(c), Colorado Revised Statutes
1973, directs the Colorado Water CO~servation Board to designate and
approve storm or floodwater runoff C:hannels or basins and to make such
designations available to legislati~ bodies of lOcal jurisdictions;
and

WHEREAS, the staff of the Board has reviewed said report and
does hereby recommend to the Colorado Water Conservation Board that
the Board designate and approve as iloodplain areas those areas
inundated by a 100-year flood (intebmediate regional flood) as
described by the floodwater surface elevations and profiles in said
report;
