(c) ELIGIBILITY FOR <br />MITIGATION ASSISTANCE.-To be <br />eligible to receive financial <br />assistance under this section for <br />mitigation activities, a State or <br />community shall develop, and <br />have approved by the Director, a <br />flood risk mitigation plan (in this <br />section referred to as a 'mitigation <br />plan'), that describes the <br />mitigation activities to be earned <br />out with assistance provided under <br />this section, is consistent with the <br />criteria established by the Director <br />under section t 361, and provides <br />protection against flood losses to <br />structures for which contracts for <br />flood insurance are available <br />under this title. The mitigation <br />plan shall be consistent with a <br />comprehensive strategy for <br />mitigation activities for the area <br />affected by the mitigation plan, <br />that has been adopted by the State <br />or community following a public <br />hearing. <br /> <br />42 U.s.C. 4101c <br /> <br />T <br /> <br />PAGE 4- I <br /> <br />CHAPTER 4: <br />GRANTS <br /> <br />FMA PROJECT <br /> <br />Purpose <br /> <br />The purpose of FMA project grants is to assist States and <br />communities in implementing flood mitigation projects to reduce <br />the risk of flood damage to NFlP-insurable structures. <br /> <br />Applicant Eligibility <br /> <br />States have the authority and responsibility for ensuring that only <br />eligible applicants receiveFMA project grants. Eligible <br />applicants include: <br /> <br />. States. <br /> <br />. Communities participating in the NFIP, excluding those on <br />probation. Suspended communities and those which have <br />withdrawn are not eligible. <br /> <br />In order to be eligible for an FMA project grant, an applicant <br />must: <br /> <br />. Have a FEMA-approved Flood Mitigation Plan. (Chapter 3 <br />of this guidance contains more information on the Flood <br />Mitigation Plan requirement.) Only mitigation activities <br />specified in an approved mitigation plan are eligible for an <br />FMA project grant. Note that the approval of a mitigation <br />plan does not guarantee approval of every project mentioned <br />in the plan. <br /> <br />. Be able to meet the FMA cost-share requirement. (The cost- <br />share requirement is described in Chapter 6 of this guidance.) <br /> <br />Project Eligibility <br /> <br />States have the authority and responsibility for determining the <br />eligibility of any project proposed in an FMA project grant <br />application. FMA project eligibility has two parts: <br /> <br />I. The project must be an eligible type of activity. <br /> <br />2.
