<br />II. <br /> <br />. <br /> <br />. <br /> <br />The Wyoming statutes encourage interested parties to effect an exchange <br /> <br />of water resources to better conserve and utilize the state's water. Unlike <br /> <br />other forms of permanent changes which must be. approved by the Board of Control, <br /> <br />exchanges need only be approved by the State Engineer. Exchanges may be <br /> <br />authorized for "any combination of direct flow, storage, and groundwater rights" <br /> <br />and are subject to the requirements of "beneficial use and equality of water <br /> <br />exchanged. " <br /> <br />C. Change in the Point of Diversion <br /> <br />Any person desiring to change the point of diversion of their water right <br /> <br />must file a petition with either the Board of Control or the State Engineer, <br /> <br /> <br />depending on whether the right has been adjudicated. If the right has not been <br /> <br /> <br />adjudicated a change in the point of diversion may only be approved if it is in <br /> <br /> <br />the vicinity of the original diversion, the water is being diverted from the <br /> <br />same source of supply, and the change does not alter the original project <br /> <br />concept. <br /> <br />As with other transfers, no change of point of diversion may be <br /> <br />granted if 'other appropriators will be injuriously affected." <br /> <br />D. Change in Location of Wells <br />Changes in well location to a point within the same aquifer and in the <br />vicinity of the original well may be made without loss of priority if approved <br />by the Board of ControL Changes in well location may be made even for <br /> <br />unadjudicated water rights. In most cases, however, the water must have been <br /> <br />applied to a beneficial use. A petition to change a well location is, of <br /> <br />course, subject to the "no harm" rule. <br /> <br />E. Temporary Changes <br /> <br />In addition to the other change provisions, Wyoming authorizes temporary <br /> <br />changes of both adjudicated and valid but unadjudicated water rights.
