The City hereby gives the State and the Corps of Engineers a <br />right to enter upon, at reasonable times and in a reasonable manner, <br />project lands which the City owns or controls, for access to Reach One <br />for the purpose of inspection and for the purpose of repairing and <br />maintaining Reach One if such inspection shows that the City for any <br />reason is failing to manage, operate, repair and maintain the flood <br />control works or flood detention areas in accordance with the assurances <br />hereunder and has persisted in such failure after a reasonable notice <br />in writing by the Corps of Engineers delivered to the City Manager of <br />the City through the Director of the State's Water Conservation Board. <br />No repair and maintenance by the United States or the State in such <br />event shall operate to relieve the City of responsibility to meet its <br />obligations as set forth in Paragraph 1 of this Agreement, or to pre- <br />clude the United States or the State from pursuing any other remedy. at <br />law or equity., <br />3. The State agrees to participate with the City in the acqui- <br />sition of lands and interests therein deemed necessary for flood <br />control purposes for Reach One (as outlined in Exhibit A, attached <br />hereto). Said participation will consist of providing Corps of Engi- <br />neers' project funds to the City in an amount not to exceed $603,560, <br />except as hereinafter provided, as deemed by the Secretary of the Army <br />to be the Federal share available under the authorization (Section 88, <br />Public Law 93-251) according to the cost-sharing formula shown in <br />Exhibit D, attached hereto.
