Dunn, Mayor <br />Town of ala the <br />Post Office Box 789 <br />Olathe, Colorado 81425 <br /> <br />Dear Mayor Dunn: <br /> <br />This is in regard to the Assurance Agreement signed by your Town on May <br />27, 1984, for emergency levee construction by the Corps of Engineers under <br />authority of Section 5 of the Flood Control Act: of August 18, 1941, as amended <br />(Public Law 99, 84th Congress, 1st Session). <br /> <br />The authorized work was completed on May 31, 1984, and consisted of <br />construction to strengthen and raise a levee along the right bank of the <br />Uncompahgre River in accordance with Contract Number DAGW05-84-P-2041. The <br />location of the work is about 1/4 mile south of the TOWII. of Olathe, in <br />Montrose County. <br /> <br />The completed levee is cons.idered a temporary structure. In accordance <br />with 33 C.F.R. part 203 local interests may ask to retaJ.n a temporary <br />structure for protection from future floods. This cannot be authorized unless <br />the works are physically improved and/ or upgraded to a permanent structure <br />status and then maintained in accordance w.ith 33 C.F.R. part 208 (copy <br />enclosed). Public Law 84/99 funds cannot be used to upgrade the structures. <br />Unless upgraded, such projects are not eligible for rehabilitation and must be <br />removed. Local interests must upgrade or remove the temporary work within 30 <br />days after the flood threat has passed, If your Town elects to upgrade the <br />levee, please submit to our office your plan and sc.hedule for the work. The <br />plan must be prepared and certified by a registered. eng:lne€lr.
