The application requests year round
flow rates from 230 cfs up to 1600 cfs. A copy of the application is attached to this memorandum.

.

The RICD statute provides that the Board may appear in water court to defend its findings with regard to
an RICD application. There a number of additional reasons why the Board may oppose the application;
therefore the Staff filed a statement of opposition in July.

The time for the filing of statements of opposition has not yet run and the Staff does not know how many
statements of opposition will be filed, or by whom.

Staff Recommendation
The Staff recommends that the Board ratify the Staff s statement of opposition for the City of Durango
RICD case.

Colorado Water Conservation Board
Flood Protection.
