Roberts:

"Would the door always remain open for
litigation?"

Mr. Chilson: ."There is this stumbling block in the way.
Apparently, it is necessary in order to
bring th.ese questions into Court for de-
. termination,. that the Uni tad States be made
a party and the United States could always.
refuse to appear. This time the United
States agreed voluntarily to become a ,party."

Mr. Tipton: "I want to call attention to the difference
in the position of Arizona and Colorado which
made litigation necessary in Ar.:i,zona's. case.
Arizona Central Valley project will not be
feasible for Arizona if Californfa's defini-
tion of consumptive use is sustained -
so the.re is an issue between those two states;
it is absolutely impossible for them to set-
tle by negotiation. W~, in Colorado, are
not in tha t same posi tion. There is no li tiga-
tion between us at this time and it wi~l be
many years before such a position develops."

Mr. Moses: "Isn't it much more likely that we will be brought
into the case if we don't actively resist?"

Mr. Chilson: "Yes.."

Mr. Moses:

"I move that Colorado follow the recommendation
of the report and acti, vely oppose this litigation."

I

Mr. Duane Barnard: "Even in the face of such opposition by the
Board, would we be dragged in? Would Colo-
rado be ready to act?"
