Make the wells in the "Lower Section" on an equal par with the rest of the water <br />rights in Colorado and with the wells in Nebraska which were grandfathered by the <br />Three State Agreement. <br />2. Help to bullet proof the Compact. If there is 120 cfs continually at the state line from <br />April I to October 15, there would never be a case in which Nebraska could claim <br />harm.. This project would be sufficient to remove approximately 50% of the days <br />below 120 cfs. <br />3. Colorado's part in the Recovery may receive higher marks because more water is <br />released for Recovery purpose when the river is low and reregulates Recovery flows <br />from higher river flows into times oflower flows. <br /> <br />. <br /> <br />Again let me reiterate that this is just an example of how the reservoir would be used both <br />by GASP to replace out of priority well depletions and by the Recovery program to legally <br />pass the Recovery water out of the state. <br /> <br />There maybe other ways to legally get the water across the state line. If there are, I have <br />not heard of them It is time for the State of Colorado to define how it will accomplish <br />the task in such a manner that the "Lower Section" can study the proposal and determine <br />how it will affect the operation of the river. <br /> <br />Weare asking for the State to participate in this project. We have discussed a grant or a <br />very low interest loan. It is obvious that this project will not do everything that needs to <br />be done to alleviate all concerns with the Compact. Moderate to extreme dry years <br />remain the challenge. <br /> <br />. <br /> <br />. <br />
