<br />Consent Agenda Item 2b <br />Case No. S-99CW047; Ski BB, LLC <br /> <br />Application Summarv <br /> <br />This is an application for groundwater, storage right and surface water rights and a Plan for <br />Augmentation on Crooked Creek near the town of Tabernash in Grand County (see attached map). <br />Applicant proposes to augment out-of-priority depletions associated with the High Mountain Lodge <br />Well No.1 and High Mountain Lodge Pond No. I with releases from High Mountain Lodge Pond <br />no. I. The High Mountain Lodge Well No.1 and Pond No. I have appropriation dates of 1980 and <br />1999, respectively. Wastewater associated with the development will be treated at the County Road <br />SO Owner's Association wastewater treatment plant. <br /> <br />CWCB Appropriations <br /> <br />The Board holds an instream flow right on Crooked Creek for 6.0 cfs during the summer months <br />and-LS-cfs during the winter; with anappropriation-date of November 27, 1990, which rnay be <br />injured by this application. <br /> <br />Potential for Iniurv <br /> <br />The Applicant's proposed Plan for Augmentation may not replace depletions to the Board's <br />instream flow water rights on Crooked Creek in the same amount, time or place as they occur. <br /> <br />Other Objectors <br /> <br />Other objectors include the State and Division Engineers, Keirnes Holding Company and the <br />Municipal Subdistrict of the Northern Colorado Water Conservancy District. <br /> <br />\\DENVER2\CWCBIBOARDMEM\July 99\consent item 2b 599CW047_S0P.doc <br />
