Sieve Arveschoug previously wrote to you. expressing the SOUtheasTern Cotorndo Water <br />Conservancy District's general concern regarding the MOA you l:T:lnsmitted to the U.S. fish and <br />WlIdllte Service, for furnishing 21.650 acre.feeT from Ruedi Reservoir this year. Southeastern's <br />concern is that the MOA doe.~ M(r.l('.arly provide that the Bureau's operation of Ruedi Reservoir, <br />including deliveries of water under the MOA, must fully comply with the Fryingpan Arkansas <br />Project ()F~,'ating Principles. <br /> <br />We bave a related, more specific concern with the MOA. Articlc 3.a provides for a lease <br />and sublease of "21,650 tlere fellt of water from the regulatory capacity of Ruedi Rcservoir, as <br />defined in Article 8 hereof. . . .' Howevcr, Article 8 of the MOA deals with envirOWllt:lllal <br />compliance, m:l. says nothing about the regulatory capacity or Ruedi Rc~crvoir. let alone define <br />!be regulatory capacity. This appean to Ix: a clc;u crrur in1l1t MOA \hat needs to be correcte4 <br />before the MOA is executed. <br /> <br />Perhaps the best way W eum:.:1 lhis error would be to add a definition of "regulatory <br />capacity" in Aruclc 1 uf thc MOA, and in Article 3.a to rcfer to the appropriate provision of <br />Article I, roithcr I.ban 10 Artiel!: 8.
