<br />'.- <br /> <br />~ <br /> <br />9. ENFORCEMENT <br /> <br />. <br /> <br />a. The Board will take such action under state law, including requesting administration by the <br /> <br />State Engineer's Office and initiating water court proceedings, as may be necessary to obtain <br /> <br />delivery of the water from the outlet works of the dam from which the water is released to the <br /> <br /> <br />beginning of the IS-mile reach and to protect the release from diversion by third parties within _ <br /> <br /> <br />the IS-mile reach, subject to such transit losses as may be imposed by the State Engineer or the <br /> <br /> <br />Division Engineer for Water Division S. Rec!!unation will cooperate with the Board to protect <br /> <br />the water released from the outlet works of the dam from which the water is being released <br /> <br />through, and to the downstream terminus of, the IS-mile reach. <br /> <br />b. The terms and conditions of this MOA shall be enforceable by any party to this agreement in . <br /> <br />a court of competent jurisdiction; Providec\, however, that before cornmencing an action for <br /> <br />enforcement of this contract, the party alleging violation shall notify the other parties in writing <br /> <br />of the alleged violation, and the parties shall make a good faith effort to resolve their differences <br /> <br />through informal discussions. <br /> <br />10. REPORTS <br /> <br />The Service shall provide a copy of the report prepared pursuant to Article 4.a. to the Ruedi <br /> <br /> <br />Water and Power Authority not later than March I, 2000. Reclamation shall also provide a <br /> <br /> <br />report to the Board, the Service, and Ruedi Water and Power Authority not later than <br /> <br />14 <br /> <br />. <br />
