<br />the promulgation of similar rules and regulations for the Arkansas and approved by Division 2 Judge <br />Anderson, and the Supreme Court's decision in the Empire Lodge case. In addition, Judge Hays' <br />decision deserves careful consideration in light of the apparent statutory authority provided to the State <br />Engineer to promulgate rules and regulations for ground water diversions. The Office of the Attorney <br />General has filed an appeal to the State Supreme Court. Oral arguments were herd in February and we <br />are awaiting a decision. The parties involved in the rule making have continued to meet to discuss <br />options. <br /> <br />Cherry Creek PMP Study: The Draft final report is finished and a project team meeting is scheduled <br />for Mar. 19 at the UDFCD offices in Denver. The agenda will include CWCB senior staff and <br />legislative representatives from Greenwood Village, Aurora, Douglas County and Englewood <br />discussing the future direction and strategy for the Cherry Creek Lake Project. <br /> <br />Currently the Corps isn't allowed to allocate or spend funds on dam safety at Cherry Creek Reservoir <br />and the state should consider language in the Corps budget that allocates funds to allow the Corps to <br />review the Applied Weather Associates Study and work on a Probable Maximum Flood Study. <br /> <br />The meeting will also be a forum for discussing the report and any final recommendations. We will <br />seek the endorsement from the local project sponsors for the study findings, which is a final step in this <br />project. <br /> <br />There will be one final meeting scheduled for April that will involve the Corps and the National <br />Weather Service. We do not expect the NWS to endorse the study because the nature of this project <br />raises questions regarding the current dam safety design paradigm. <br /> <br />We hope to make a Board presentation on the issues and the study in the future. <br /> <br />Denver Publishes Model Ordinances: Denver water has published several model ordinances to <br />promote water conservation on its web site www.water.denver.co.gov. The ordinances include: <br /> <br />. A rain sensor ordinance. <br />· A sub-metering ordinance (designed to conserve water within apartments and condos). <br />. Soil Preparation Ordinance. <br />· . Turf Limitations Ordinance. <br />. Waste of Water Ordinance. <br />· Median Sub-Surface Irrigation Ordinance. <br />· Restrictive Covenants Ordinance. <br /> <br />The models indicate how much water might be saved if such <br />measures were implemented. <br /> <br />Floodplaiu Easement Helps Bike Path Development: Six years <br />ago, the South Suburban Park Foundation launched a plan to build <br />a bike path connecting the Mary Carter Greenway to the bike path <br />system along the High Line Canal. The resulting path known as <br />the "Greenway" is now a bike path system that runs from <br />Chatfield Reservoir to the confluence of Cherry Creek and the <br />South Platte River. One component is the Big Dry Creek Trail. <br /> <br />A new clear span bridge over the Platte River was installed last <br />Fall 2002 at the confluence of the River and Big Dry Creek, <br />culminating six years offundraising and development of the Big <br />Creek Trail.
