<br />- 2, <br /> <br />, <br /> <br />--- --- <br />$250,000 for costs associated with hiring a historian, creating an imaged database, and for other travel and <br />related costs to prcpare for litigation with the basin states and the fcderal government involving the (. <br />Colorado Rivcr and the law of the river. Of this amount, $100,000 has been committed to a contract with <br />Doug Littlefield, a historian specializing in interstate watcr matters, We expect to expend the remaining <br />$150,000, of the $250,000 dedicated, to imaging contracts and other travel costs within the ncxt several <br />months. Finally, the Office of the Attorney General requested, and the Board authorized the expenditure <br />of $750,000 for costs associated with complying with the litigation between Kansas and Colorado on the <br />Arkansas River. <br /> <br />The current balance of the Litigation Fund is approximately $2,041,619, which accounts for some interest. <br />Amidst these expenditures, and the transfer of funds from the litigation fund to the Species Conservation <br />Trust Fund several years ago, several of the seven basin states in the Colorado River basin continue to <br />threaten to engage in multi-state litigation that could cost millions of dollars and take decades to complete, <br />Arizona has rccently shored up its litigation fund, and the Southern Nevada Water Authority and the State <br />of Nevada have indicated that money will not be a limiting factor if it engages in litigation involving the <br />Colorado River. <br /> <br />Staff Recommendation <br /> <br />The Staff and the Department of Natural Resources recommend that the CWCB: <br /> <br />1. Authorize the Staff to forward the attached report to the appropriate committees; and, <br /> <br />2, <br /> <br />Fornmlly recommend that construction fund bill be amended to restore the litigation fund, from <br />the mineral severance tax operation account, up to the original $4 million. <br /> <br />(. <br /> <br />. <br /> <br />Flood Protedion .
