This is an application for ground water rights, surface water right, change of water right, and a plan
for augmentation and exchange. Applicant seeks adjudication of a surface water right for the
Slough and Banning Lateral, RFP Enlargement for 2 cfs and ground water rights for RFP Pond Nos.
1 through 11 for 4 AF each, Applicant also seeks to change the water rights decreed to the Slough
and Banning Lateral to fill, refill and continuously fill the RFP Ponds 1-11 for wildlife, aesthetic,
piscatorial, and recreational uses, Applicant proposes to fill and refill the ponds either with ground
water tributary to the Roaring Fork River or with the Slough and Banning Lateral water.
Applicant's plan for augmentation and exchange includes water from Green Mountain Reservoir,
Ruedi Reservoir, Troy Ditch, and Edith Ditch.

Potential for Injury:

The Applicant's proposed augmentation plan may injure the Board's instream flow water rights on
the Roaring Fork River by not replacing out-of-priority depletions in time, place and amount.
