Aoplication SummarY

This is an application for a change of water rights on the Blue River near Breckenridge in Summit
County (see attached map). In case no. 5-92CW008, the Applicant obtained approval of a plan for
augmentation for the operation of fourteen wells intended to serve the development of up to
fourteen single-family lots. Terms and conditions were included that protected the Board's
instream flow water rights on the Blue River. The development has since been reduced to ten lots,
creating a surplus of augmentation water from the decreased demand. In this application, the
Applicant proposes two additional single-family units, one with a caretaker unit and 500 square feet
of outside irrigation. Since the well located on the property is an exempt household use only well
(permit no. 158955) and cannot be used for irrigation or caretaker units, the Applicant proposes to
use the surplus water from case no. 5-92CW008 to augment the entire use from the well.

Potential for Iniurv

The Applicant's proposed change of water rights may deplete the Board's instream flow water
rights on the Blue River. The proposed change of water rights may result in an expansion of water
rights. Furthermore, the use of water must comply with the terms of the CWCBNidler Tunnel
Water Company Memorandum of Agreement.
