Public Comment on Agenda Item 9a, Upper Gunnison River <br />Water Conservancy District Cases 86CW202 and 86CW203 (2:31 - 2:52 p.m.) <br /> <br />Richard Bratton, representing the Upper Gunnison Water Conservancy District, <br />requested the Board intervene in the appeal of the Upper Gunnison cases and file <br />an amicus brief with the Colorado Supreme court in support of the Upper Gunnison <br />WCD position. Eric Kuhn, representing the Colorado River Water Conservation <br />District, spoke in support of the proposal. Dave Miller, representing Arapahoe <br />County, spoke in opposition. Discussion followed by Jackson, Martineau, Lochhead <br />and Wright. The staff was asked to research the record for a similar request made <br />at the 1988 CWCB meeting in Steamboat Springs. The Board considered a motion <br />on this item Friday morning. <br /> <br />9. Matters in Litigation - Report on Items Discussed in Executive Session <br />(2:52 - 2:57 p.m.) <br /> <br />a. <br /> <br />Upper Gunnison River Water Conservancy District Cases 86CW202 and <br />86CW203 <br />AWDI Water Rights Application: Case No. 3-86CW46 <br />Case No 5-88CW382; U.S.A. Stipulation <br />Black Canyon National Monument Federal Reserved Water Right <br /> <br />. <br /> <br />b. <br />c. <br />d. <br /> <br />Wendy Weiss, AG's staff, gave a summary report on matters discussed in executive <br />session during lunch. Item 9a was not discussed during lunch in executive session. <br />Informational items 9b and 9d, were presented to the Board in executive session by <br />Jennifer Gimbel and Gene Jencsok, respectively. Item 9c was presented by Wendy <br />Weiss. Harrison and Lochhead were recused from the discussion of item 9c. <br /> <br />During the open meeting, a motion was made by Smith and seconded by Eisel to <br />approve the proposed stipulation in item 9c subject to being able to reach a separate <br />agreement with the U. S. that will provide additional protection for the Board's rights <br />through the enforcement of Green Mountain contracts. The motion passed by <br />unanimous (7-0) decision. <br /> <br />10. Colorado Wilderness Act of 1991 (2:57 - 3:31 p.m.) <br /> <br />a. Status of federal legislation <br />b. Status of quantification efforts for wilderness water requirements <br /> <br />. <br /> <br />The subject was introduced by David Walker, CWCB. Dan Merriman, CWCB staff, <br />made a presentation using overheads. Comments were heard from Chuck Hendricks, <br />regional Forester's Office, USFS; Wendy Weiss, AG's office; Roger Flynn, <br />Environmental Defense Fund; and Anne Vickery, Colorado Mountain Club. Todd <br />Robertson, with Colorado Environmental Coalition, invited CWCB staff to attend <br /> <br />5 <br />
