Limitations on use of Metcalf Ditch and Raw Water Booster Station: <br /> <br />1.c.O) The Applicants seek a decree establishing the following <br />alternate points of diversion for the water rights desc:n'bed m paragraphs 7 and 8.B. of the <br />Application filed herem: <br /> <br />l.c.(1)(a) Metca.]rijea.dpl~ is located on the north bank of <br />the Eagle RIver in Section 7, Township S South, Range 81 West of the 6th P.M. at a point <br />from which the SE comer of the SW~ of said Section 7 bears S 53'OO'40"E 1446 feet. <br /> <br />l.c.(l)(b) ]bw Water Booster Plll~ Hea.l!iate is located on <br />the north bank of the Eagle River at a point from which the SW comer of the NW% of <br />Section 12, Township 5 South, Ranse 82 West of the 6th P.M. bears S 18"01'34" W 1551.13 <br />feet. . <br /> <br />1.c.(2) The Board has adjudicated certain instream flow water <br />tights pursuant to authority granted the Board in CR.5. i 37-92-101, etselJ. The rights <br />adjudicated were as follows: <br /> <br />l.c.(2)(a) Case No. So.CW-134, ninimum stream flow in the <br />natural stream channel of the Eagle River from its confluence with Gore Creek to its <br />confluence with Lake Creek: <br /> <br />85 c.r.s., May 1 through September 30; and <br />3S c.f.s., October 1 through April 30 <br /> <br />1.c.(2)(b) Case No. 8o.CW-126, IJIjnimum stream flow <br />decreed in the natural channel 'of the Eagle River from its confluence with Lake Creek to <br />its confluence with Brush Creek: <br /> <br />110 d.s., May 1 through September 30; and <br />45 d.s., October 1 through April 30 <br /> <br />l.c.(3) One alternate point of diversion sought is coincident with <br />the point of diversion for the Metcalf Ditch and is upstream of the currently decreed points <br />of diversion of all of Applicants' water. rights listed in paragraphs 7 and 8.B.. of the <br />Application. The second alternate point of diversion is known as the Raw Water Booster <br />Pump and is also upstream of the currently decreed points of diversion for Applicants' water <br />rights listed in paragraphs 7 and B.B. <br /> <br />1.c.(4) To the extent that diversions at the upstream alternate <br />points at the Metcalf Ditch and/or at the Raw Water Booster Pump of the above-described <br />water rights of Applicants would diminish instream flows in the Eagle River below those <br />specified in paragraph 1.c.(2) above between said alternate point(s) of diversion and the <br /> <br />-2- <br />
