<br />~ <br /> <br />" <br /> <br />e <br /> <br />e <br /> <br />e <br /> <br />Memorandum <br />Agenda Item 18j <br />November 1, 1991 <br /> <br />Case No. S-91CW078; Kensington Land Investment & Galena Partners <br /> <br />The Board ratified the statement of opposition filed in this case at its September, <br />1991, meeting. The applicants request approval of a supplemental plan of augmentation, <br />change of conditional water storage rights, and change of water rights on Squaw Creek and <br />the Eagle River. Applicants intend to augment out-of-priority depletions by numerous <br />junior groundwater and surface water diversions which supply a residential development, <br />with consumptive use credits claimed from several senior irrigation water rights, releases <br />from on-site reservoirs and with water purchased from Green Mountain Reservoir. <br />Applicants are also requesting two upstream alternate points of diversion for all decreed <br />points of diversion owned by the applicants (see attached map). The Board holds instream <br />flow decrees on Squaw Creek and the Eagle River which could be injured by the proposed <br />out-of-priority depletions and upstream exchanges. <br /> <br />Proposed Stipulation <br /> <br />The attached stipulation, which has been accepted by the applicants and <br />recommended by the Attorney General's staff, includes virtually the same terms and <br />conditions proposed in Case No. 5-91CW077. <br /> <br />Staff Recommendation <br /> <br />The staff recommends that the Board take separate action on each of the proposed <br />stipulations and, 1) ratify the attached stipulation with Stag Gulch & Kensington Land <br />Investment Partners and, 2) ratify the attached stipulation with Kensington Land Investment <br />& Galena Partners. <br /> <br />DCM/MU/ <br />Attachments <br />File: merge.stp <br />
