The applicants request approval of a supplemental plan of augmentation,
change of conditional water storage rights, and change of water rights on Squaw Creek and
the Eagle River. Applicants intend to augment out-of-priority depletions by numerous
junior groundwater and surface water diversions which supply a residential development,
with consumptive use credits claimed from several senior irrigation water rights, releases
from on-site reservoirs and with water purchased from Green Mountain Reservoir.
Applicants are also requesting two upstream alternate points of diversion for all decreed
points of diversion owned by the applicants (see attached map). The Board holds instream
flow decrees on Squaw Creek and the Eagle River which could be injured by the proposed
out-of-priority depletions and upstream exchanges.

Proposed Stipulation

The attached stipulation, which has been accepted by the applicants and
recommended by the Attorney General's staff, includes virtually the same terms and
conditions proposed in Case No. 5-91CW077.

Staff Recommendation

The staff recommends that the Board take separate action on each of the proposed
stipulations and, 1) ratify the attached stipulation with Stag Gulch & Kensington Land
Investment Partners and, 2) ratify the attached stipulation with Kensington Land Investment
& Galena Partners.

DCM/MU/
Attachments
File: merge.stp
