Applicant is proposing to augment out-of-priority depletions <br />by five domestic wells serving a 150 unit housing development with augmentation water <br />purchased from Ruedi Reservoir, releases of water from an on-site pond, or by dedicating <br />upstream senior consumptive use credits to the stream. <br /> <br />CWCB Appropriation <br /> <br />The Board holds an instream flow water right on the Roaring Fork River for 55 cfs, <br />summer, and 30 cfs, winter, with an appropriation date of November 8, 1985, which could <br />be injured by this application. . <br /> <br />Potential for Injurv <br /> <br />The proposed use of Ruedi Reservoir as an augmentation source will not replace out- <br />of-priority well depletions at the point they occur on the stream. The maximum injury which <br />could be expected to occur as a result of this application has been calculated at 0.030 cfs. <br />This represents approximately 0.054 percent of the Board's summer instream flow on the <br />Roaring Fork River. To date, there have been nine other de minimis impacts to this reach <br />of Roaring Fork River. The cumulative impact on this reach of the Roaring Fork River, <br />including this application, equals 0.880 percent of the Board's instream flow right. The staff <br />has not filed a statement of opposition in this case in accordance with Board procedures <br />regarding de minimis injuries. <br />
