<br />, <br /> <br />e <br /> <br />e <br /> <br />e <br /> <br />Agenda Item 6 <br />October 31, 1991 <br /> <br />GUIDELINES <br /> <br />iK..,r(, <br />[) The Board shall only a:i,ept conditional water rights for change to <br />absolute instream flow water rights after identification and evaluation of the, <br />effects the potential acceptance would have on existing water uses and on <br />future development of Colorado's compact entitlement. Should this <br />evaluation identify significant7negative effects, the Board shall not aeeeflt the <br />conditional water rights. '?{oVJ ~ C""-se by C<>-SC b""~ <br /> <br />@ The Board shall not accept a conditional water right for change to <br />instream flow purposes unless all decreed existing water uses, undecreed <br />exchanges, and decreed junior conditional water rights for which facilities <br />have been constructed or are substantially under construction within or <br />upstream from the specified instream flow reach can be protected (not be <br />subject to curtailment) from a call of the conditional water right. <br /> <br />CD Prior to ~~~~;'t~ any conditional ~ater right, the Board shall evaluate <br />whether it would be appropriate to combine or stack the conditional water <br />right with any other instream flow water right in order to achieve the <br />minimum flow necessary to preserve the natural environment to a reasonable <br />,degree. If the Board elects to combine or stack the conditional water right, <br />the details of how the water rights are to be combined will be addressed in <br />the decree for the changed conditional water right. <br /> <br />PROCEDURES <br /> <br />1. Prior to accepting any.such conditional water right, the Board shall <br />determine whether a natural environment exists in the reach to be protected; <br />the amount of water that is physically and legally available to the conditional <br />water right; and whether the natural environment in the specified reach will <br />be preserved to a reasonable degree by the water physically and legally <br />available to the conditional water right. <br /> <br />2. Prior to accepting any conditional water right, the Board shall request <br />recommendations from the Division of Wildlife, the Division of Parks, the <br />United States Department of Agriculture and the United States Department <br />of Interior regarding the adequacy of the conditional water right to meet the <br />minimum flow necessary to preserve the natural environment to a reasonable <br /> <br />2 <br /> <br />I <br />
