SUBJECT: Senate Bill No. , Concerning Water and Amending the
Water Right Determination and Administration Act of 1969 -
Agenda Item for Board Meeting, February 5, 1973.

In his recent message to the Colorado General Assembly,
Governor Love recommended that legislation be considered which
would make the state of Colorado a party to proceedings relating to
changes in points of diversion in order to insure compliance with
the state's goals and plans The state's policy in this field is
practically nonexistent at this time, except as is established by
that portion of the constitution relating to the appropriation of
water.

The Governor requested that I prepare proposed
to implement his recommendation to the General Assembly.
I have prepared such legislation, the pertinent parts of

1. 148-21-18, Colorado Revised Statutes 1963, (1969 Supp.),
as amended, is amended BY THE ADDITION OF A NEW SUBSECTION (6) to
read:

148-21-18. Application for water riqhts or chanqes of such
riqhts - plans for auqmentation. (6) The people of the state of
Colorado, through the executive director of the department of natural
resources or such assistants as he may designate, shall be a party to
all proceedings initiated under this section to the extent necessary
to insure compliance with such state policy concerning the use of land
and water resources as may be established by law and in effect at the
time any application is filed under this section.
