Sparks, Director. <br /> <br />SUBJECT: Senate Bill No. , Concerning Water and Amending the <br />Water Right Determination and Administration Act of 1969 - <br />Agenda Item for Board Meeting, February 5, 1973. <br /> <br />In his recent message to the Colorado General Assembly, <br />Governor Love recommended that legislation be considered which <br />would make the state of Colorado a party to proceedings relating to <br />changes in points of diversion in order to insure compliance with <br />the state's goals and plans The state's policy in this field is <br />practically nonexistent at this time, except as is established by <br />that portion of the constitution relating to the appropriation of <br />water. <br /> <br />The Governor requested that I prepare proposed <br />to implement his recommendation to the General Assembly. <br />I have prepared such legislation, the pertinent parts of <br />follows: <br /> <br />legislation <br />Accordingly, <br />which are as <br /> <br />1. 148-21-18, Colorado Revised Statutes 1963, (1969 Supp.), <br />as amended, is amended BY THE ADDITION OF A NEW SUBSECTION (6) to <br />read: <br /> <br />148-21-18. Application for water riqhts or chanqes of such <br />riqhts - plans for auqmentation. (6) The people of the state of <br />Colorado, through the executive director of the department of natural <br />resources or such assistants as he may designate, shall be a party to <br />all proceedings initiated under this section to the extent necessary <br />to insure compliance with such state policy concerning the use of land <br />and water resources as may be established by law and in effect at the <br />time any application is filed under this section. <br />
