<br />I <br /> <br />Governor Love recommended that legislation be considered which would <br />make the state of Colorado a party to proceedings relating to changes <br />in points of diversion in order to insure compliance with the state's <br />goals and plans. The state's policy in this field is practically non- <br />existent at this time. except as is established by that portion of the <br />constitution relating to the appropriation of water. <br /> <br />This recommendation by the Governor grew out of the Holland and Hart <br />report in which it was recommended that the state be represented in <br />water proceedings for the purpose of insuring that state policy was <br />being carried out. The Governor requested that I draft a bill to <br />accomplish that recommendation. That bill is in your folders. It <br />states that the director of natural resources shall be a party to all <br />proceedings initiated for changes in points of diversion to the extent <br />necessary to insure compliance with such state policy concerning the <br />use of land and water resources as may be established by law and in <br />effect at the time any application is filed. <br /> <br />Either this statutory enactment or the constitutional amendment that <br />we have been talking about previously would constitute a factor then <br />which the state would monitor to be sure that it was being carried <br />out. Any land use policy that the state might adopt in the future <br />would be covered by this. It has been introduced. It was introduced <br />by Senator Anderson and Representative Edmonds. I think it will <br />probably be taken up this week. <br /> <br />Mr. Stapleton: Is there any action needed on this? <br /> <br />Mr. Sparks: This is part of the Governor's message. and presumably <br />we should take some action on it. <br /> <br />Mr. Stapleton: As I understand it. all this means is that there is <br />another necessary party to a lawsuit.
