All revenue generated pursuant to contract~ executed under section 8, except <br /> <br />for those revenues generated pursuant to the surcharges described in section 9, shall be credited <br /> <br />first to lllIDUa! operatiolls and mai ntenancc costs and thcn to repayment ofthe project in the year <br /> <br />thc contract revenue is generated; Provided, however, that the revenues so credited shall not be <br /> <br />applied so as to reduce the lllnounl of the current annual payments due to the Secretary from the <br /> <br />project contractors or any other parties which are responsible for paying outstanding <br /> <br />reimbursable construction costs." <br /> <br />"Sec. 11. Non-project water diverted, stored, impounded, pumpcd. or conveyed under a <br /> <br />contract entered into pursuunt to section 8 shall be exempt from any acreage limitation provisions <br /> <br />of the Act ofJune 17, 1902 (32 Stat. 388), and acts amendatory thereof and supplementary <br /> <br />thereto, including, but nat limited to, the Reclamation Reform Act of 1982 (96 Stat. 1263, 43 <br /> <br />D.S.C. 99390aa - 390zz-l) and from any farm unit size limitations established pursuant to 16 <br /> <br />U.S.C. 9590z-2(c)(5); Provided. however. that in the event such non-project water is <br /> <br />commingled wilh project water in Reclanlation project facilities, and the resulting commingled <br /> <br />supply is used la irrigate lands in a projcct contractor's service area, then such commingled water <br /> <br />shall bear the same acreage limitations or farm unit size limitations as the project waler unless-- <br /> <br />(a) contract provisions are in et'tect which provide that project or non-project water, or <br /> <br />both, will be accounted for on a quantitative basis, that project water will not be delivered to <br /> <br />ineligible land, und lhat appropriate charges, as determined by the Secretury, will h", paid Lor th", <br /> <br />project water; and <br /> <br />(b) the charges for the use of the excess capacity include an 3ppropriatc interest <br /> <br />1%4l9.2 <br /> <br />Drqft January / /,2001 (if.:49pm) <br />
