Floodplain Management Program - South Platte River Right-of-Way Request

INTRODUCTION

At the November 6-7, 1995, Board Meeting, approval was given to grant requests for easements
in CWCB's right-of-way along the Chatfield Downstream Channel Improvement Project on a
case-by-case basis, The Board has received a request from Kahn Construction for an easement
involving land owned by the CWCB, adjacent to the South Platte River. The requested easement
would be used to construct and maintain a stormwater outfall system, See attached letter.

DISCUSSION

Kahn Construction requests an easement for a stormwater drainage outfall system into the South
Platte River channel. There are a number of CWCB project features and previous easements
granted near the requested easement area,

Use for the Requested Area is for the construction and maintenance of a 24-inch diameter
stormwater drainage line, If granted, the easement will not restrict any future easements/activities
within the CWCB project ROW,

Conditions for the Easement - If the easement is granted, the grantee shall comply with the
following conditions:

I) TIME PERIOD - The EASEMENT shall be for a term of 25 years with renewal
provisions,

PERMITS - The grantee shall be responsible for securing and monitoring all required
federal, state, and local permits pertaining to Colorado waters and streams,
