<br />. <br /> <br />. <br /> <br />. <br /> <br />DECREE PROPOSED FOR SETTLEMENT BETWEEN <br />SAN LUIS VALLEY IRRIGTION DISTRICT AND THE <br />COLORADO WATER CONSERVATION BOARD <br />MAY 13, 2005 <br /> <br />Program, including wells, other diversions and storage ponds located within the District's <br />boundaries that are used for non-agricultural purposes including in-house domestic, <br />domestic, including lawn and landscape irrigation, commercial, industrial, pond evaporation <br />and stockwatering (hereafter referred to as the "Participating Structures"), <br /> <br />7, To be included in the Applicant's Augmentation Program, owners of <br />Participating Structures must contract for water from the Applicant which issues an <br />Agreement and Augmentation Certificate approved by the Division Engineer. All <br />Participating Structures must be located within the District's boundaries. <br /> <br />8. The Applicant presently implements its Augmentation Program through three <br />existing decrees entered in Case Nos. 84CW16, 93CW43 and 94CW62, District Court, <br />Water Division No.3. <br /> <br />9, The Applicant will include in its Augmentation Program water previously <br />changed from irrigation use in Case No, 86CW30, Concerning the Application for Water <br />Rights of BAR. Cattle Company, District Court, Water Division No.3, and decreed in that <br />case as "credit water" for beneficial use for "long-term leases, sale to and use by another, <br />dedication of the credit water to use in a judicially-approved plan for augmentation, or any <br />other means of actual beneficial use of water." (1[ 7 of the decree in Case No. 86CW30). <br />The total amount of Acredit water@ decreed in Case No. 86CW30, was 106,99 acre feei as <br />follows: <br /> <br />(1) South Fork Hiqhline Ditch: <br /> <br />(a) Date Decreed: May 1, 1896. <br /> <br />(b) Civil Action: In the Matter of Adjudication of the Priorities of <br />'Water Rights-in'Water-Gistrict-Noc 20,Gestilla-GflUlTty-Gistrict <br />Court. <br /> <br />(c) <br /> <br />Legal Description: The headgate is located North 20 16' <br />West 8 chains from the SW corner of Section 34, Township <br />40 North, Range 3 East of the N,M.P.M. <br /> <br />Page 3 of21 <br />
