This agenda item presents a proposed stipulation with the San Luis Valley Water Conservancy
District for the entry of a decree granting its application for approval of a plan for augmentation,
including exchange, By entering into this stipulation, the Board would agree to accept de minimis
impacts to several instream flow water rights that may result from this umbrella augmentation plan,
Staff and the Attorney General's Office have worked extensively with the District and the Division
of Water Resources to develop the proposed decree,

The San Luis Valley Water Conservancy District ("District"), through its Augmentation Program
Enterprise, operates an Augmentation Program operates to provide augmentation water to
Participating Structures, including wells, other diversions and storage ponds, located within the
District's boundaries that are used for non-agricultural purposes, including in-house domestic,
domestic including lawn and landscape irrigation, commercial, industrial, pond evaporation and
stockwatering, Each Participating Structure diverts surface water or ground-water from the Rio
Grande Basin including the Rio Grande mainstem, its tributaries, the confined aquifer tributary to the
Rio Grande and the unconfined aquifer,

93CW43, and 94CW62, District Court, Water Division No, 3, The CWCB stipulated to the entry of
a decree in Case No, 94CW62 with terms and conditions similar to those proposed today in this case,
Both the District's size and the demand for augmentation water within the District have increased
since the entry of those decrees, Accordingly, the District has acquired additional sources of
augmentation water for its Augmentation Program and filed this application to add those sources of
replacement water to its Augmentation Program, By this application, the District seeks to include in
its Augmentation Program water previously changed from irrigation use in the B.A,R, Cattle
Company Case No, 86CW30 (referred to as "credit water"), which, under that decree may be
dedicated to use in a judicially-approved plan for augmentation. The District's request to use the
