"

e

e

e

Existing Water Right Information

Staff has analyzed the water rights tabulation and consulted with the Division Engineer's Office
to identify any potential water availability problems, Appendix D shows the decreed water rights
listed on the State Engineers Water Right Tabulation List within this reach of stream. The
surface diversions within this reach of stream total 145 cfs, Most of the stream diversions within
this reach of stream are junior in priority to senior diversions totaling 15 cfs, which are located
downstream of Wilson Creek (see Fourmile Creek Senior Water Rights in Appendix D).
However, there maybe times when the downstream senior water rights are not calling water
through this reach of stream, this may allow the upstream junior water rights to deplete some
parts of this stream reach, In addition, it maybe possible for upstream junior water rights to
divert water, depleting some parts of the stream reach before their irrigation return flows return
to the stream. Based on this analysis staff has determined that water should be available for
appropriation on Fourmile Creek, between Trail Gulch and Felch Creek, to preserve the natural
environment to a reasonable degree without limiting or foreclosing the exercise of valid existing
water rights,

CWCS Staff's Instream Flow Recommendation
Staff recommends the Board form its intent to appropriate on the following stream reach:

Stream: Fourmile Creek
Water Division: 2
Watershed: Fourmile Creek
Counties: Fremont
Upper Terminus: Trail Gulch at (Latitude 380 37' 34") (Longitude 1050 12' 58")
Lower Terminus: Felch Creek at (Latitude 380 32' 35") (Longitude 1050 13' 13")
Length: 6,9 Miles
USGS Quad(s): Cripple Creek South and Cooper Mountain
Flow Recommendation: 9,10 cfs (April 15th - October 14th)
4,75 cfs (October l5'h - April 14'h)

Fourmile_trai_ wilsonUSF _RPT
Last printed 01/07/00 2:40 PM
