Existing Water Right Information

Staff has analyzed the water rights tabulation and consulted with the Division Engineer Office to
identify any potential water availability problems, Appendix D shows the decreed water rights
listed on the State Engineers Water Right Tabulation List within this reach of stream, The
surface diversions within this reach of stream total 4,0 cfs. However, these water rights are
junior in priority to a majority of water rights on Foumile Creek, Based on this analysis staff has
determined that water is available for appropriation on Fourmile Creek, between High Creek and
Cripple Creek, to preserve the natural environment to a reasonable degree without limiting or
foreclosing the exercise of valid existing water rights,

Staff recommends the Board form its intent to appropriate on the following stream reach:

Water Division: 2
Watershed: Fourmile Creek
Counties: Fremont and Teller
Upper Terminus: High Creek at (Latitude 38048' 48") (Longitude 1050 15' 27")
Lower Terminus: Cripple Creek at (Latitude 380 39' 59") (Longitude 1050 13' 42")
Length: 3.4 Miles
USGS Quad(s): High Park and Cripple Creek South
Flow Recommendation: 8,20 cfs (April 15th - October 14th)
4,10 cfs (October 15th - April 14th)
