<br />Agenda Item 6s <br />Case No. 5-98CW290; WTS Cabin Partners, L lD <br /> <br />Application Summary <br /> <br />This is an application for a plan for augmentation on Castle Creek near the Town of Aspen in <br />Pitkin County (see attached map). Applicant is proposing to augment domestic and irrigation <br />depletions associated with the WTS wells with excess consumptive use credits left over from the <br />decreed augmentation plan in Case No. 5-95CW330. The CWCB found the impacts in Case <br />No. 5-95CW330 to be DeMinimis. The use of the additional CD credits, ifnot accounted for in <br />5-95CW330 could result in an additional impact of 0.008% to the stream. Augmentation credits _ <br />come from the Devaney Creek Ditch. <br /> <br />CWCB ApprOPriations <br /> <br />The Board holds an instream flow water right in case no. 5-76W2947 for Castle Creek in the <br />amount of 12 cfs with an appropriation date of January 14, 1976 which could be injured by this <br />application. <br /> <br />Potential for Iniurv <br /> <br />Applicant's proposed plan for augmentation may not replace depletions to the Board's instream <br />flow water rights on the Castle Creek in the same time, amount or location at which they occur. <br />Although the depletions to Castle Creek are less than I %, the DeMinirnis rule does not apply and a <br />statement of opposition must be filed according to the rules and regulations concerning the <br />Colorado Instream Flow and Natural Lake Level Program. <br /> <br />Other Obiectors <br /> <br />Other objectors include the City of Aspen. <br /> <br />L:\BOARDMEMlMazcl199\agcnda itcm...6s.doc <br /> <br />,...7:J <br />
