<br />treasurer to transfer a specified amount of moneys from the operational <br />account reserve in the severance tax trust :funa to the cash fund on Juiy <br />1,2005. Requires the general assembly to appropriate up to a specified <br />amount of moneys in the cash fund in the 2005-06, 2006-07, and 2007-08 <br />fiscal years to the Colorado water conservation board (board) for <br />distribution of grants pursuant to the grant program. Limits grants to <br />applicants who supply, distribute, or otherwise provide water at retail to <br />customers or who establish outreach or education programs to <br />demonstrate the benefits of water efficiency. <br />Requires the board to establish guidelines for the grant program if <br />no other applicable guidelines exist, and specifies that the guidelines are <br />to include deadlines and procedures for applicants to follow and criteria <br />for prioritizing and awarding grants. Repeals the grant program on July <br />1,2008. <br /> <br />1 Be itenacted by the General Assembly of the State of Colorado: <br />2 SECTION 1. 37-60-126 (1), (2) (b), and (7), Colorado Revised <br />3 Statutes, are amended, and the said 37-60-126 is further amended BY <br /> <br />4 <br />5 <br /> <br />THE ADDITION OF A NEW SUBSECTION, to read: <br />37-60-126. Water conservation and drought mitigation <br /> <br />6 planning - programs - relationship to state assistance Cor water <br />7 Cacilities - guidelines - water efficiency grant program - repeal. <br />8 (1) Ai; used in this section and in section 37-60-126.5, unless the context <br />9 otherwise requires: <br />10 (a) "AGENCY" MEANS A PUBUC OR PRIVATE AGENCY WHOSE <br />11 PRIMARY PURPOSE IS THE PROMOTION OF WATER RESOURCE <br />12 CONSERVATION. <br /> <br />13 (a) (b) "Covered entity" means each municipality, agency, utility, <br />14 including any privately owned utility, or other publicly owned entity with <br />15 a legal obligation to supply, distribute, or otherwise provide water at <br />16 retail to domestic, cOlDlDercial, industrial, or public facility customers, <br /> <br />17 <br /> <br />and that has a total demand for such customers of tWo thousand acre-feet <br /> <br />-2- <br /> <br />. <br /> <br />. <br /> <br />tit <br /> <br />1254 <br />
