<br />" <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />COLORADO WATER CONSERVATION BOARD <br />721 State Centennial Building <br />1313 Sherman street <br />Denver, CO 80203 <br /> <br />September 7, 1995 <br /> <br />RESOLUTION <br /> <br />WHEREAS, the Colorado Water Conservation Board owns and maintains easements along <br />the South Platte River in agreement with the U.S. Army Corps of Engineers as part of the <br />Chatfield Downstream Channel Improvement Project; and <br /> <br />WHEREAS, the Colorado Water Conservation Board has received requests from <br />governmental entities and private parties for access and usage of these Chatfield Downstream <br />Channel Improvement Project lands; and <br /> <br />WHEREAS, C.R.S. 24-82-201, 1973, allows state agencies to extend easements on state <br />land only to other governmental entities thereby prohibiting extension of easements to private <br />parties; and <br /> <br />WHEREAS, the U.S. Service Forest has for the past three decades extended Special Use <br />Permits to private citizens for 1) ingress and egress across federal lands, 2) uses of forest service <br />roads and rights-of-way, and 3) uses of water facilities on or surrounded by federal lands; and <br /> <br />WHEREAS, the Colorado State Land Board has for the past ten years extended Special <br />Use Permits to private citizens for I) ingress and egress across state lands, 2) uses of state land <br />roads and rights-of-way, and 3) uses of water and other facilities on or surrounded by state lands; <br />and <br /> <br />WHEREAS, the Colorado Water Conservation Board has recently been requested to <br />provide easements to two private individuals who own property immediately adjacent to South <br />Platte River channel easements; and <br /> <br />WHEREAS, the Colorado Water Conservation Board seeks to cooperate with private <br />individuals to promote the best interests of the State and its citizenry; <br /> <br />WHEREAS, the Colorado Water Conservation Board has prepared a Special Use Permit <br />to grant permission for use of State lands by private individuals; and <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Colorado Water Conservation Board <br />in regular meeting assembled in Lamar, Colorado, this 7th day of September, 1995, that it does <br />hereby recommend to adopt the use of Special Use Permits for use of lands owned and/or <br />maintained by the Board. <br />
