DISCUSSION

The CWCB staff has met with staff from the State Land Board (SLB) regarding Special
Use Permits. Such permits are used most often by the SLB to allow private individuals to cross
state lands. The CWCB staff has obtained a copy of the SLB's Special Use Permit and
developed a model permit for use by the CWCB. The CWCB staff has provided 1) a model
permit, 2) proposed resolution, and 3) other pertinent information to the AG's Office. By
adopting the "special use permit" authority, the Board, can issue permits for any period of time
and at whatever cost the Board deems appropriate. Such costs could be used to recover 0 & M
monies for the project. A copy of the proposed permit is attached.

RECOMMENDATIONS

The CWCB staff proposes to implement the Special Use Permit for activities on CWCB
easement rights-of-way which are proposed and undertaken by private individuals (entities).

Proposed Motion

See attached resolution.

Motion By
second By
For
Against

'.

"

-

e

e
