<br />The Cardoza bill aims to further define the critical habitat designation process, altering the deadlines . <br />for defining habitat areas, requiring more input before the designations, and excluding land that is <br />involved in any other habitat conservation plan from consideration. <br /> <br />The Walden "sound science" measure would require the Fish and Wildlife Service and the National <br />Marine Fisheries Service to give greater weight to field-tested and peer-reviewed data before listing a <br />species under ESA. <br /> <br />The legislation would require agencies to gather more information before writing a recovery plan for <br />each proposed species. The bill would set minimum standards for scientific or commercial data, <br />requiring it to include sorne field-survey data and give greater weight to field work that has been peer- <br />reviewed. For more <br />information visit www.NWRA.org. <br /> <br />Statewide <br /> <br />ISF Rules Published in Colorado Register: At the July 2004 Board meeting, the CWCB adopted <br />new rules concerning acquisitions of water, water rights or interests in water for instream flow use. <br />The adopted ISF Rules were published in the September 10, 2004 edition of the Colorado Register, and <br />will become effective on September 30, 2004. The adopted Rules and the Statement of Basis and <br />Purpose can be found on the CWCB web site at htlo://www.cwcb.state.co.us/isfi.Programslisf- <br />rules.htrn <br /> <br />2003 Instream Flow Water Right Appropriations: On Aug. 14, the Division 5 Referee entered <br />rulings granting six of our 2003 ISF applications. The Attorney General's Office is negotiating <br />settlements in three contested applications in Division 5. In the 2003 Division 3 ISF applications, the <br />CWCB staff and the AG's Office are working with the Div. 3 Division Engineer on language to be <br />included in the decrees. <br /> <br />Drought Update: Summer precipitation was above average east of the continental divide and below <br />average on the West Slope.
