(please see the attached map). The change of water rights includes an upstream movement
of water. The Applicant seeks to augment depletions associated with diversions for snowmaking,
municipal uses, and evaporative losses at the resort with a number of different augmentation
sources.

CWCB Appropriations

The Board holds the following instream flow water rights that could be injured by this
application:

Case No.
l-78W8016
1-87CW285
1-80CW379A
1-80CW379

Stream/Lake
Middle Boulder Creek
Jenny Creek
South Boulder Creek
South Boulder Creek

Amount (cfs/aft
12
1
12
15/6

At'propriation Date
7/11/1978
12/11/1987
7/11/1978
7/11/1978

Potential for Iniurv

The Applicant's proposed change of water rights may injure the CWCB's water rights by diverting
at upstream points of diversion when the CWCB's instream flow water rights are not being
satisfied. The Applicant's augmentation plan may injure the CWCB's water rights by not
adequately replacing depletions in time, place, and amount.

Other Objectors

The other objectors in this case include: the Water Users Association of District 6; the City of
Boulder; FRICO; the City of Louisville; the Anderson Ditch Co.; the Howard Ditch Co.; and the
City of Lafayette.

L:\Section Folders\SECC\Case Files\2002\102CW400_mem.doc
