Many of our designations have rescinded <br />previously designated information. <br /> <br />Rule 11. Incorporation bv Reference <br /> <br />Due to advice form Peggy Ventura on "incorporation by <br />reference." we may want to change our lists of approved <br />technical methods in Rules 5 and 6. These methods are <br />listed to help engineers. but the methods are constantly <br />being revised and updated. We should stay current. but it <br />may be an unnecessary burden to constantly revise the rules <br />every time there is a refinement in the "state of the <br />art". I suggest a good way to handle this would be to <br />simply make a rule that directs the staff to maintain. and <br />annually revise. a list of approved hydrologic and <br />hydraulic methodologies that would be available for <br />inspection. <br /> <br />Rule 13. Revision of Rules <br /> <br />This rule is standard verbiage for most rules and provides <br />a procedure for change at some future date should we find <br />any of the rules to be unreasonable. unworkable. a <br />hardship. or technically deficient. Richard Mark of <br />Westminster and Larry Lang have suggested a variance rule <br />should be added to the rules. I believe enough wiggle room <br />has been incorporated in the present draft and that if we <br />do find experience shows a problem. we can make the <br />revisions under this rule 13. <br /> <br />I feel that all other significant technical issues <br />regarding the proposed rules have been satisfactorily resolved. <br /> <br />/bj <br /> <br />-12- <br />
