<br />. <br /> <br />Memorandum/Issues/Rules <br />September 22, 1987 <br /> <br />Rule 6. Standards for Approximate Information <br /> <br />This rule basically conforms to the pOlicy regarding <br />approximate information formally adopted by the Board at <br />its November, 1984, meeting. One of the main purposes in <br />designating approximate information was to recognize FEMA's <br />unnumbered A zones where some counties (Eagle, La Plata, <br />and Weld) felt official status was necessary in order to <br />comply with FEMA rules for continued participation in the <br />NFIP. <br /> <br />Proposed Rule 6.B, Hydrology, requires that, at a <br />minimum, the peak discharge for the 100-year flood be <br />determined. This is intended to help make future analysis <br />less costly to a developer who may be required by local <br />ordinances to preform a detailed analysis in order to <br />develop property shown in the approximate floodplain. <br /> <br />Rule 7. Criteria for Analvzinq Dams <br /> <br />. <br /> <br />This rule has been written to address an issue that has <br />developed regarding Standley Lake in Westminster. It <br />incorporates the latest thinking and policy statements of <br />the UD&FCD as stated in their Resolution No. 36, Series of <br />1986 - POlicy for the Delineation of Floodplains Below <br />Water Supply and Other Non-Flood Control Reservoirs. The <br />rule takes into account the current Colorado law concerning <br />liability for damages resulting from the flow of water from <br />a reservoir. This law states that no reservoir owner <br />"shall be liable for allowing the inflow to such a <br />reservoir to pass through it into the natural stream below <br />such reservoir" (Section 37-87-104(2) CRS). <br /> <br />Rule 8. Criteria for Analvzinq Levees <br /> <br />This rule has been written to establish statewide policy on <br />how to delineate areas that appear to be protected by <br />levees. The wording and intent has been primarily derived <br />from FEMA rules and regulations, Section 65.10, Mapping of <br />Areas Protected by Levee Systems. <br /> <br />Rule 9. Desiqnation and Approval <br /> <br />. <br /> <br />Proposed Rule 9.B, Base Flood, establishes the 100-year <br />flood (see definition 22) as the basis for regulation of <br />floodplains in Colorado for zoning purposes. Current <br />statutes regarding the CWCB duties do not consistently <br />refer to the magnitude of the regulatory floodplain as the <br />100-year flood. However, the 100-year flood has been <br />adopted as a national standard by FEMA for administration <br /> <br />-10- <br />
