We <br />anticipate that people may raise concerns and have comments <br />about these issues at the October 1, 1987, pUblic hearing. <br /> <br />Rule 2. Authoritv <br /> <br />Many comments we received on previous drafts have <br />indicated a general lack of knowledge about our basic <br />designation and approval authority. In addition, several <br />comments indicated confusion over how our program relates <br />to floodplain maps prepared by FEMA and the UD&FCD. Some <br />people may also question if these rules apply to home rule <br />cities. <br /> <br />The proposed Statement of Basis and Purpose should provide <br />the needed legal rational for our program. A point should <br />be made that the Board's duty and responsibility, in <br />addition to the designation and approval of floodplains <br />for zoning purposes, is to "devise and formulate methods, <br />means, and plans for ... the prevention of flood <br />damages..." 37-60-106(1)(c). This may help explain why, <br />for example, delineation of the 500-year floodplain is <br />important. <br /> <br />To avert confusion about our program, I recommend we <br />include in the staff's presentation at the hearing a brief <br />history of CWCB designations, number of miles studied, <br />what agencies prepare floodplain information and perhaps <br />the staffs expertise in these matters. <br /> <br />4B20E <br />
