At the last meeting of the Biological Opinion discussion <br />group and in comments submitted on the March 5 preliminary draft opinion, water users requested <br />that the Service incorporate language into the biological opinion stating that existing depletions <br />remain classifIed as existing depletions, even if the use changes or the point of diversion changes. For <br />example, if an existing agricultural depletion is converted to municipal use, it remains in the "existing <br />use category," or ifa transmountain diversion is transferred from one location to another it will also <br />remain in the existing use category. At the end of page 15, add the following: <br /> <br />(. "Existing depletions shall remain as existing depletions regardless of any subsequent change, <br />exchange, or abandonment of the water rights resulting in such depletions.
