Reinitiation of Category 1 consultations due to failure to provide 10,825 AF/yr. In the comments submitted on the March 5 draft, water users requested inclusion ofthe following language: "Any action taken by the Service as a result of failure to provide the 10,825 acre-feet of water to the Program as a component of the Reasonable and Prudent Alternative for Category I depletions will apply to and affect all depletions within Category I in the same manner. In particular, in the event that the Service reinitiates consultation on a biological opinion for depletions included in Category I because part or all ofthe 10,825 acre-feet of water has not been provided to the Program in accordance with applicable agreements, consultation will be reinitiated for all biological opinions for Category I depletions." This language needs to be added at the end of the last paragraph on page 8, and in the Reinitiation Notice. 7
