In the <br />comments submitted on the March 5 draft, water users requested inclusion ofthe following language: <br /> <br />"Any action taken by the Service as a result of failure to provide the 10,825 acre-feet of water <br />to the Program as a component of the Reasonable and Prudent Alternative for Category I <br />depletions will apply to and affect all depletions within Category I in the same manner. In <br />particular, in the event that the Service reinitiates consultation on a biological opinion for <br />depletions included in Category I because part or all ofthe 10,825 acre-feet of water has not been <br />provided to the Program in accordance with applicable agreements, consultation will be reinitiated <br />for all biological opinions for Category I depletions." <br /> <br />This language needs to be added at the end of the last paragraph on page 8, and in the Reinitiation <br />Notice. <br /> <br />7 <br />
