Table 2 shows that the summer flow recommendation of 56 cfs is available at least 50% of the
time from March 15th through July 14th. The winter flow recommendation of 25 cfs is available
at least 50% of the time from July 15th through November 14th. The winter recommendation was
further reduced to 19 cfs for the time period of November 15th through March 14th, based on
limited water availability.

Precipitation Data
Staff reviewed a local precipitation data set from one site located around the Muddy Creek
Drainage (see Precipitation Data in Appendix C). Table 3 shows the water year and the percent
of average precipitation recorded at each site. It is staff's opinion that the 12 years of stream-
flow data analyzed is representative of average water-years.

T bl 3 P

D

fA

a e reClpltatlOn ata as a percentage 0 verage
Elevation = 5690
Lat 38 5200
Long 107 35 00
Year Paonia ISW
1990 93%
1991 89%
1992 122%
1993 133%
1994 77%
1995 123%
1996 102%
1997 117%
1998 78%
1999 75%
Averaqe 96%

Table 3 shows that the 12 years of stream flow data analyzed is representative of slightly below
average water years.

Existing Water Right Information

Staff has analyzed the water rights tabulation and consulted with the Division Engineer's Office
(DEO) to identify any potential water availability problems. There are no decreed surface
diversions within this reach of stream. According to the DEO, there is usually sufficient water
available within this stream reach to satisfy the recommended instream flow amount. Based on
this analysis, staff has determined that water is available for appropriation on Muddy Creek from
the confluence of East and West Muddy Creeks to the inlet of Paonia Reservoir, to preserve the
natural environment to a reasonable degree without limiting or foreclosing the exercise of valid
existing water rights.

- 5 -
