<br />Table 2 shows that the summer flow recommendation of 56 cfs is available at least 50% of the <br />time from March 15th through July 14th. The winter flow recommendation of 25 cfs is available <br />at least 50% of the time from July 15th through November 14th. The winter recommendation was <br />further reduced to 19 cfs for the time period of November 15th through March 14th, based on <br />limited water availability. <br /> <br />Precipitation Data <br />Staff reviewed a local precipitation data set from one site located around the Muddy Creek <br />Drainage (see Precipitation Data in Appendix C). Table 3 shows the water year and the percent <br />of average precipitation recorded at each site. There are no decreed surface <br />diversions within this reach of stream. According to the DEO, there is usually sufficient water <br />available within this stream reach to satisfy the recommended instream flow amount. Based on <br />this analysis, staff has determined that water is available for appropriation on Muddy Creek from <br />the confluence of East and West Muddy Creeks to the inlet of Paonia Reservoir, to preserve the <br />natural environment to a reasonable degree without limiting or foreclosing the exercise of valid <br />existing water rights. <br /> <br />- 5 - <br />
