Whitten <br />State Engineer <br />Division of Water Resources <br />State of Colorado <br />Denver, Colorado <br /> <br />Dear Mr. Whitten: <br /> <br />You will recall that Resolution No. 2 adopted <br />at the conference of the Western Association of State <br />Engineers in August; requests that each of the member <br />states cooperate with the State of Nevada in the presenta- <br />tion of the Hawthorne Case, Nevada, Ex ReI Shamberqer v. <br />United States, No. 1247, in the U. S:-District Court for <br />the Di st rict of Nevada. . I am enclosing a summary of the <br />status of that case dated October 22, that was prepared <br />from material furnished by the Director of the Department <br />of Conservation and Natural Resources and the office of <br />the Attorney General of Nevada. I am also enclosing a <br />copy of Resolution No.2. <br /> <br />As indicated in the summary, Nevada will be <br />filing its opening brief within the next few dayp. I <br />understand from Hugh Shamberger that he plans to arrange <br />to have copies sent to each of the ~& states of the <br />Association. This Department plans to ask leave to file <br />a brief amicus curiae in support of Nevada's position. <br />We will be glad to cooperate in any way in furnishing <br />you information concerning the case. We would also be <br />glad to have representatives of other state wate.r <br />agencies as cosignatories of our brief, if they are in- <br />terested in doing so and approve our presentation. <br /> <br />Very truly yours, <br /> <br />HARVEY o.
