No later than <br />2 December 31, 2010, the Secretary shall submit a report on the utilization of power . <br />3 revenues to the Subcommittees on Energy and Water Development for the Senate and <br />4 House Committees on Appropriations. The Secretary shall also make a recommendation <br />5 regarding the need for additional funding .that may be required to fulfill the goals of the <br />6 Recovery Implementation Programs. WESTERN AND RECLAMATION SHALL <br />7 MAINTAIN SUFFICIENT REVENUES IN THE COLORADO RIVER BASIN FUND <br />8 TO MEET THEIR OBLIGATION TO PROVIDE BASE FUNDING IN <br />9 ACCORDANCE WITH THIS PROVISION. IF WESTERN AND RECLAMATION <br />10 DETERMINE THAT THE FUNDS IN THE COLORADO RIVER BASIN FUND ARE <br />11 NOT BE SUFFICIENT TO MEET THE OBLIGATIONS OF SECTION 5 (c) OF THE <br />12 COLORADO RIVER STORAGE PROJECT ACT FOR A THREE YEAR PERIOD, <br />13 WESTERN AND RECLAMATION SHALL REQUEST APPROPRIATIONS TO <br />14 MEET BASE FUNDING OBLIGATIONS. Nothing in this Act shall otherwise modii)' or <br />15 amend existing agreements among participants regarding base funding and depletion fees <br /> '.. . <br />16 for the Recovery Implementation Programs. <br />17 (e) AUTHORITY TO RETAIN APPROPRIATED FUNDS.--At the end of each fiscal <br />18 year any unexpended appropriated fundsJor capital projects shall be retained for use in <br />19 future fiscal years. Unexpended funds that are carried over shall continue to be used to <br />20 implement the capital projects needed for the Recovery Implementation Programs. <br />21 (f) ADDITIONAL AUTHORITY.--The Secretary may enter into agreements and <br />22 contracts with federal and non-federal entities; acquire and transfer interests in land, <br />23 water and facilities; and accept or give grants in order to carry out the purposes of this <br />24 Act. <br />25 (g) INDIAN TRUST ASSETS.--As much of the potential water development in the San <br />26 Juan River Basin is for the benefit of Indian tribes and most of the federally designated <br />27 critical habitat for the endangered fish species in the Basin is on Indian trust lands, <br />28 nothing in this Act shall be construed to restrict the Secretary, acting through <br /> . <br /> 6 <br />
