<br />NOTICE TO CONTEST AND NOTICE OF PARTY STATUS
<br />
<br />Contestant, Pacific/Desert Partners, LLC ("Pacific/Desert"), through its
<br />undersigned counsel, and pursuant to Rule 5, I of the Rules Concerning the Colorado
<br />Instream Flow ("ISF") and Natural Lake Level Program, hereby provides Notice to
<br />Contest and Notice of Party Status regarding the ISF appropriation for Horsefly Creek,
<br />in Water Division 4, former Water District 60, Montrose County, Colorado,
<br />
<br />I, Pacific/Desert owns property commonly known as Hideout Lake Ranch in
<br />the upper reaches of Horsefly Creek, Pacific/Desert owns adjudicated and
<br />unadjudicated water rights for Hideout Lake Ranch; the rights divert (or will divert)
<br />from tributaries of Horsefly Creek, and include, without limitation, the storage right for
<br />Paxton Reservoir, the fill rights associated with the reservoir, and several springs and
<br />wells. Pacific/Desert's water rights may be adversely affected by the ISF,
<br />
<br />2, Pacific/Desert is contesting the ISF appropriation for 13.1 cfs (April I _
<br />June 5) on Horsefly Creek, in the segment which begins at the confluence of Sheep
<br />Creek and ends at the confluence with the San Miguel River.
<br />
<br />3. Pacific/Desert has engaged the services of Pete Foster of Wright Water
<br />Engineers, Inc. to evaluate the data collected by the USGS stream gage for Maverick
<br />Draw near Norwood, CO (10 #09175400), to determine the applicability of this data to
<br />the Horsefly Creek drainage, and to provide additional information on available flows
<br />in Horsefly Creek, Upon information and belief, Pacific/Desert questions whether there
<br />are sufficient flows on Horsefly Creek to meet the ISF flow recommendation of 13.5
<br />cfs,
