to have a springing executory interest in the Board's water right that would vest if the Board were to
be disbanded as more specifically described in the MOD. Finally, the Board would obtain an
instream flow water right as described under Agenda Item No, 33, The CWCB's appropriation is
integral to the Board's settlement, and will be addressed under Agenda Item No. 33. A proposed
decree in that case is attached to the Agenda Item No, 33 memo.

Staff recommends that the Board:

Attachments

Authorize the Staff of the CWCB and the Attorney General to enter into a settlement of
Case No, 4-99CW267 by agreeing to a decree no less restrictive than the proposed
decree, attached hereto;
Authorize the Staff of the CWCB and the Attorney General to enter into a settlement of
Case No. 4-99CW268 by agreeing to a decree no less restrictive than the proposed
decree, attached hereto;
Authorize the Staff of the CWCB and the Attorney General to enter into a settlement of
Case No. 4-99CW268 that requires the USFS to seek to include the language identified in
the Spring Creek Special Interest Area, in the GMUG Forest Management Plan;
Authorize the Staff of the CWCB and the Attorney General to sign the stipulation
attached to this memorandum; and,
Authorize the Staff of the CWCB and the Attorney General to enter into a settlement of
the Board's appropriation, in a manner described in Agenda Item No, 33.
