<br />. <br /> <br />. <br /> <br />No. 99CW267 <br /> <br />Slate River, tributary to East River, tributary to the Gunnison River. <br /> <br />Legal description of the point of diversion, <br /> <br />The center ofthe main Mt. Emmons Iron Fen is in the NE/4 SW/4 SE1/4 <br />Section 6, T. 14 South, R. 86 West ofthe 6th Principal Meridian in the <br />Gunnison National Forest. The point is described as being located 1873 feet <br />from the East section line and 1194 feet from the South section line, Latitude <br />38051' 51.9" North and Longitude lOr 2' 38,8" West. <br /> <br />Use of water: <br /> <br />Water for irrigation of riparian habitat (14 acres) and wildlife use, <br /> <br />Date of initiation of appropriation: <br /> <br />December 10,1999 <br /> <br />7. The appropriation was initiated by posting notice at the site <br /> <br />8. Amount of water claimed (ABSOLUTE): <br /> <br />0,033 cfs. <br /> <br />4, <br /> <br />5. <br /> <br />6, <br /> <br />TERMS AND CONDITIONS: <br /> <br />9. The Application is granted for 0.033 cfs for wildlife use and for incidental <br />irrigation of riparian vegetation, "Incidental irrigation" refers to irrigation that <br />occurs as the water arises in the spring area. The right for such incidental <br />irrigation does not confer the right to take any further actions or construct any <br />devices to increase the area or the consumptive use of such irrigation. The claim <br />for any amounts above 0,033 is hereby dismissed with prejudice, <br /> <br />10, This decree is entered pursuant to the stipulation of the parties and because ofthe <br />unique characteristics and circumstances concerning Mt. Emmons Iron Bog <br />Spring, and therefore establishes no precedent or expectation or interest with <br />respect to any other stream within the State of Colorado. The parties shaH not cite <br />this decree as precedent in any other proceeding in the State of Colorado, <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree in the amounts specified above, and is <br />hereby entered for wildlife use and incidental irrigation, The appropriation date for this <br />water right is December 10, 1999, <br /> <br />2 <br />
