<br />Attached please find a copy of Purchase and Sale Agreement for a Perpetual Easement for a Minimum
<br />Pool, which was dated June 22, 1999, This was executed today by Director John Mumma, on behalf of
<br />the Division. Once it has been approved by the State's Attorney General and Controller, a fully executed
<br />original will be sent to you. The Capital Development Committee is scheduled to discuss this at their
<br />meeting on September 16".

<br />The Division has obtained a Water Rights Appraisal Report for storage rights in DeWeese Reservoir,
<br />located in Custer County, Colorado, This was prepared by Peter D. Boddie, HRS Water Consultants,
<br />8885 West 14" Avenue, Lakewood, Colorado 80215, and is dated August 30", 1999. The report
<br />established a value of $707,000.00 for a perpetual lease. This is based on a value of $1,000,00 per acre- a
<br />foot for 500 acre-feet of storage space, plus a value of $2,300,00 per acre-foot for 90 acre-feet of water to .-
<br />cover evaporation replacement.
<br />
<br />In compliance with Section 301, of the Uniform Relocation Assistance and Real Property Acquisition
<br />Policies Act of 1970, Public Law 91-646, the Colorado Division of Wildlife has established this value of
<br />$707,000.00 as an estimate of just compensation,
<br />
<br />The parties agree that said appraisal shall have no effect upon the purchase price of $500,000.00. This
<br />was established by your offer and is the accord made in the Purchase and Sale Agreement. Further, the
<br />difference between the purchase price and the appraised value may be considered a donation.
<br />
